PRO MEDIA PLAYER — TERMS OF SERVICE

1. Acceptance of Terms
By creating an account or using Pro Media Player ("App," "Platform," "Service"), you agree to these Terms of Service ("Terms").
If you do not agree, you may not use the Service.
2. Description of Service
Pro Media Player is a digital media hosting and streaming platform that allows:
- Artists to upload and distribute original audio content
- Users to stream and interact with hosted media
- Creators to manage and publish their content
Pro Media Player does not claim ownership of user-uploaded content.
3. User Accounts
To access certain features, you must create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account
- Not impersonate any person or entity
You are responsible for all activity under your account.
4. User-Generated Content
Users may upload audio files and related metadata.
By uploading content, you represent and warrant that:
- You own the content or have obtained all necessary rights, licenses, and permissions
- Your content does not violate any laws or third-party rights
You grant Pro Media Player a non-exclusive, worldwide, royalty-free license to:
- Host
- Store
- Stream
- Encode
- Display
- Distribute the content within the platform
This license exists solely for operating the Service.
You retain full ownership of your content.
5. Metadata & Content Accuracy
You agree to provide accurate metadata for all uploaded content, including:
- Artist name
- Track title
- Featured contributors (if applicable)
- Content classification (e.g., explicit content)
Providing false or misleading metadata may result in content removal or account suspension.
6. Copyright & Intellectual Property
You may not upload:
- Content you do not own or control
- Content that infringes copyrights, trademarks, or other rights
- Content subject to exclusive third-party agreements
We reserve the right to remove infringing content and terminate repeat infringers.
7. Sampling & Third-Party Content
You represent and warrant that any samples, interpolations, or derivative elements used in your content have been fully cleared.
This includes:
- Master recording rights
- Composition rights
- Publisher approvals
Uncleared samples are strictly prohibited.
Pro Media Player reserves the right to remove any content suspected of containing unauthorized samples.
You assume full responsibility for any claims arising from sampled or third-party content and agree to indemnify Pro Media Player accordingly.
8. DMCA Compliance
If you believe content infringes your copyright, contact:

Include:
- Identification of copyrighted work
- Location of infringing content
- Your contact information
- Statement of good faith belief
- Statement under penalty of perjury
- Your electronic or physical signature
We will respond in accordance with applicable law.
9. Prohibited Conduct
Users may not:
- Upload unlawful or infringing content
- Distribute malware or harmful code
- Circumvent platform security
- Harass, abuse, or impersonate others
- Attempt unauthorized access to accounts or systems
10. Content Moderation
We reserve the right to:
- Remove content
- Suspend or terminate accounts
- Investigate violations
We are not obligated to pre-screen content.
11. Termination
We may suspend or terminate accounts that violate these Terms.
Users may delete their account at any time.
12. Disclaimers
The Service is provided "as is" without warranties of any kind.
We do not guarantee uninterrupted or error-free operation.
13. Limitation of Liability
To the maximum extent permitted by law, Pro Media Player shall not be liable for:
- Indirect or consequential damages
- Lost profits or data
- Content disputes between users

You agree to indemnify and hold harmless Pro Media Player from any claims, damages, liabilities, or expenses arising from:
- Your uploaded content
- Your violation of these Terms
- Any infringement of third-party rights
15. Governing Law
These Terms are governed by the laws of the State of Washington, United States.
